1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the Wolky.ch website and its services (collectively, the "Service"), operated by Wolky SA (c/o Alessandro Soldati, Strada Regina 41, 6991 Neggio, Switzerland) ("Wolky"). By creating an account or using any part of the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not accept these Terms or the Privacy Policy, you must not use the Service.

These Terms constitute a legally binding agreement between you (the user) and Wolky. Please read them carefully. If you use the Service on behalf of a company or other legal entity (for example, a funeral home, newspaper, or association), you represent that you have the authority to bind that entity to these Terms.

2. Eligibility and Geographic Scope

The Service is intended for use by individuals and businesses located in Switzerland. By registering for an account, you confirm that you are a Swiss resident or that your business is established in Switzerland. You must also be at least 18 years old (or the age of majority in your canton) and capable of entering into a binding contract to use Wolky.

We do not knowingly offer the Service to minors or users outside our intended service region. We reserve the right to refuse access to the Service to anyone, or to limit access to users outside Switzerland, at our discretion.

3. Service Description

Wolky.ch is a Swiss digital platform dedicated to death notices, tributes, and memorial services. Our services include:

Main services:

  • Online death notice publication

  • Coordination of publication in partner newspapers

  • Management of condolences and testimonials

  • Permanent digital memorial garden

  • Organisation of memorial donations

  • Directory of funeral homes and associated services

Community features:

  • Interactive condolence space

  • Sharing of memories and testimonials

  • Memorial anniversary notifications

  • Photo and document galleries

4. Account Registration

Account creation: To use certain Service features (such as publishing a death notice, adding a condolence, creating a memorial alert, or managing donations), you must register for a user account. During registration, you must provide a valid email address and your name, and choose a secure password. If you create an account on behalf of an organisation (funeral home, newspaper, association), you must provide the organisation's details as requested and have the authority to do so.

Account information: You agree to provide truthful, accurate, and complete information during the registration process and to keep your account information up to date. This includes promptly updating any contact or business information if it changes. Wolky is not responsible for losses or problems arising from inaccurate or outdated information you provide.

Single account: Each user or business entity should maintain only one account, except with our explicit authorisation (for example, you might have a personal account and a separate organisation account according to our Service design). You may not create an account using a false identity or on behalf of someone else without authorisation.

5. Account Security and Responsibility

Credential security: You are responsible for maintaining the confidentiality of your account login credentials (email and password). Do not share your password with anyone. If you suspect your account has been compromised (for example, if you notice unauthorised activity or lose control of your password), you must notify us immediately via our support contact.

Account use: You are responsible for all activities that occur under your account. Any action taken through your account will be presumed to have been authorised by you. We strongly recommend using a strong, unique password and enabling any additional security features we may offer. Wolky will not be responsible for losses or damages resulting from your failure to protect your account credentials.

Unauthorised access: We reserve the right to suspend or terminate any account we believe has been compromised or is being used fraudulently or in violation of these Terms, to protect you, Wolky, and other users.

6. Data Sources and Disclaimer

Multiple sources: Information published on Wolky.ch comes from various sources, including:

  • Data submitted directly by users and families

  • Public sources (civil registries, archives, etc.)

  • Newspaper and media publications

  • Funeral homes and industry professionals

  • Third-party databases and information services

No guarantee of accuracy: Given the diversity of sources and sensitivity of information, we cannot guarantee the accuracy, completeness, or timeliness of all published information. Data is reproduced and presented for informational and memorial purposes only. We strive to maintain information quality and accuracy, but errors, omissions, or outdated information may occur.

Limited use: All content available on Wolky.ch is intended exclusively for personal and memorial use. Commercial use, resale of information, or exploitation of data for profit without our explicit written authorisation is strictly prohibited.

7. Modification Requests and Third-Party Rights

Modification process: Any request for modification, correction, or deletion of a death notice or associated information must be submitted via our contact form available at https://www.wolky.ch/en/contact. We are committed to processing these requests promptly, generally within 48 working hours.

Legitimate requests: Requests from close family members, legal representatives, or persons with legitimate interest will be prioritised. Supporting documentation may be requested to verify the legitimacy of the request.

Third-party rights: We respect third-party rights and will diligently address any claims regarding inaccurate information, privacy violations, or inappropriate content. In case of disputes concerning publication or modification of information, we reserve the right to temporarily suspend display of contested content whilst reviewing the situation.

8. Free and Paid Services

Wolky offers both free and paid services adapted to memorial needs.

Free services:

  • Viewing death notices

  • Database searching

  • Simple condolence posting

  • Access to memorial garden

  • Viewing funeral home and newspaper directories

The free offering is provided as a courtesy to allow access to basic memorial features. Wolky reserves the right to modify free features, impose limitations, or remove certain aspects of the free offering at any time, with reasonable notice.

Paid services:

  • Personalised death notice publication

  • Publication in partner newspapers

  • Condolences with photos or elaborate messages

  • Premium memorial garden features

  • Extended notification services

  • Memorial donation management

Paid services are offered according to a tariff schedule available on our site. When you order a paid service, you agree to pay the applicable fees and all taxes in force. Prices are displayed in Swiss francs (CHF) and may include or exclude VAT according to details provided at purchase.

No refund policy: All payments are final once the service has been rendered. Due to the sensitive and immediate nature of memorial services, there are no refunds or pro-rata cancellations, except as required by law. We provide detailed information about each service and encourage users to evaluate their needs before making a purchase.

9. Memorial Donations and Contribution Management

Donation terms: When you make a memorial donation in memory of a deceased person via our platform, you accept that this contribution is made directly to Wolky SA and not directly to the selected charitable association.

Transfer commitment: Wolky SA formally commits to transferring the entire amount collected, minus management fees, to the charitable association you have designated. This transfer occurs at regular intervals, generally monthly, or as soon as the collected amount reaches a minimum threshold allowing efficient transfer.

Management fees: Wolky SA takes an administrative commission on each donation to cover management costs, payment processing, administrative monitoring, and transfer to associations. This commission never exceeds 15% of the donated amount.

Traceability and transparency: We maintain a precise register of all donations collected and transfers made to each association. Upon justified request, we can provide information on the status of your donation and the planned or completed transfer date to the relevant association.

Tax receipts: Donations made through Wolky SA are not tax deductible.

Limited liability: Wolky SA cannot be held responsible for the actions or internal management of beneficiary associations. Our responsibility is limited to correct transfer of collected funds to the designated association, minus announced management fees.

10. Fees, Billing, and Payment Terms

Payment processor: All payments for Wolky Services are processed by our secure payment provider, Stripe. By providing payment information, you accept Stripe's terms and conditions and privacy policy. We do not process and store complete credit card details directly on our servers.

Currency and taxes: All fees are indicated and billed in Swiss francs (CHF). They may be inclusive or exclusive of Swiss VAT according to details provided at purchase. We comply with Swiss tax legislation. You are responsible for all other applicable taxes according to your situation.

Billing: For paid services, billing occurs at the time of service activation. For newspaper publications, additional fees may apply according to each newspaper's publication rates.

11. User Obligations and Acceptable Use

By using Wolky, you agree to use the Service responsibly and respectfully, particularly given the sensitive nature of memorial services.

Respectful and legal use:

  • Use the Service only for legitimate memorial purposes

  • Respect the memory of the deceased and sensitivity of bereaved families

  • Refrain from publishing false, misleading, or defamatory information

  • Not use the Service for illegal activities or those contrary to good morals

Appropriate content:

  • Ensure the truthfulness of information provided when publishing notices

  • Use respectful and appropriate language in condolences and testimonials

  • Refrain from publishing offensive, discriminatory, or inappropriate content

  • Respect copyright and intellectual property rights in shared photos and texts

Technical security:

  • Not introduce viruses, malware, or harmful code

  • Not attempt to gain unauthorised access to systems

  • Not disrupt the Service's integrity or performance

  • Refrain from using automated scripts without authorisation

Commercial use:

  • Not resell Service access without written authorisation

  • Not use site data for unauthorised commercial purposes

  • Respect usage limitations for free accounts

If you violate these obligations, we may suspend or terminate your account and you may be subject to legal consequences.

12. Intellectual Property Rights

Our intellectual property: The Service, including all software, source code, design elements, logos, trademarks, presentation, and content organisation, is the intellectual property of Wolky SA or its licensors. The unique formatting, design, and site functionality remain our property even when basic data comes from public sources.

We grant you a limited, non-exclusive, non-transferable, and revocable licence to use the Service for personal and memorial purposes, in accordance with these Terms. You acquire no ownership rights in the Service itself.

User content: You retain all rights to content you publish (death notices, photos, testimonials, condolences). By publishing content, you grant us a limited licence to host, display, and process it according to Service needs. This licence includes the ability to present content to site visitors and retain it for memorial archiving purposes.

Respect for third-party rights: You guarantee that you have the necessary rights to any content you publish and that it does not infringe third-party rights. You undertake not to publish photos, texts, or other elements protected by copyright without appropriate authorisation.

13. Personal Data Protection

We process personal data in accordance with the GDPR and Swiss data protection law (LPD). Given the sensitive nature of memorial information:

Processing purposes:

  • Provide memorial and publication services

  • Manage user accounts and communications

  • Respect our legal and archival obligations

  • Improve Service quality and security

Sensitive data: We treat all information relating to the deceased and bereaved families with particular care. Access to this data is strictly limited to authorised personnel and legitimate Service purposes.

User rights: In accordance with applicable regulations, you have rights of access, rectification, deletion, and portability of your data. For data relating to deceased persons, requests may be processed by close family members or legal representatives.

14. Third-Party Services and Links

The Wolky Service may integrate or provide links to third-party services, including:

  • Stripe for payment processing

  • Newspapers for publications

  • Mapping services for funeral home location

  • Donation platforms for charitable contributions

We are not responsible for the content, policies, or practices of these third-party services. Their respective terms apply to your interactions with them. However, we carefully select our partners to ensure quality and security of integrated services.

15. Limited Liability and Exclusions

Service provided "AS IS": Wolky.ch is provided "as is" and "as available". Whilst we strive to offer a reliable Service adapted to memorial needs, we do not guarantee that the Service will be uninterrupted, error-free, or entirely free from technical problems.

Limitation of liability: To the fullest extent permitted by law, Wolky SA will not be liable for indirect, incidental, or consequential damages arising from:

  • Errors or omissions in data published by third parties

  • Temporary Service interruptions

  • Disputes concerning accuracy of memorial information

  • Technical problems affecting content availability

Exceptions: This limitation does not apply in cases of gross negligence, intentional fault, or fraud on our part, nor for liabilities that cannot be excluded under Swiss law.

Backup and archiving: We maintain regular backups and data protection measures, particularly important for preserving memorial content. However, we do not guarantee complete restoration of all data in all possible scenarios.

16. Indemnification

You agree to indemnify and hold Wolky SA harmless from all claims, losses, or damages (including legal fees) resulting from:

  • Your violation of these Terms

  • Your misuse of the Service

  • Publication of inaccurate or defamatory information

  • Any violation of third-party rights by your content

  • Any dispute with third parties arising from your use of the Service

This indemnification obligation survives any termination of your account or this agreement.

17. Suspension and Termination

By you: You may stop using the Service at any time. To close your account, follow the instructions in your settings or contact us. We recommend exporting important data before closure, as access will be permanently removed. Published memorial content may remain accessible to preserve the memory of the deceased, except upon explicit request for deletion.

By us: We may suspend or terminate your access in the following circumstances:

  • Violation of these Terms or inappropriate use of the Service

  • Publication of manifestly false or defamatory information

  • Disrespectful behaviour towards bereaved families

  • Illegal activities or security threats

  • Non-payment for ordered services

Memorial preservation: Upon account termination, legitimate memorial content (death notices, respectful condolences) may be retained to preserve the memory of the deceased, in accordance with our public memorial service mission.

Service discontinuation: Should Wolky SA cease operations, we would provide at least 60 days' notice and take measures to preserve access to memorial content, potentially by transfer to an appropriate organisation.

18. Changes to Terms

Wolky SA may revise these Terms to adapt to legal, technical, or service developments. Important changes will be notified by email or visible notice on the site, with appropriate notice period considering the ongoing nature of memorial services.

Continued use of the Service after changes take effect constitutes acceptance of revised Terms. If you do not accept changes, you must stop using the Service.

19. Applicable Law and Jurisdiction

These Terms are governed exclusively by Swiss law, without regard to conflict of law principles. Application of the Vienna Convention on Contracts for the International Sale of Goods is expressly excluded.

Any dispute will be submitted to the exclusive jurisdiction of the competent courts of Canton Vaud, Switzerland. Consumers residing in Switzerland may have the right to bring proceedings in their canton of residence under consumer protection laws.

20. Miscellaneous Provisions

Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Wolky SA concerning the Service.

Severability: If any provision is deemed invalid, it will be modified to the minimum necessary or removed, with other provisions remaining in force.

No waiver: Our failure to enforce any provision does not constitute waiver of that provision.

Assignment: You may not assign your rights without our consent. We may assign this agreement as part of business restructuring.

Language: In case of translation of these Terms into other languages, the French version shall prevail in case of interpretation differences.
